Bail hearing delayed for man charged after fatal crash

MEDICINE HAT, ALTA- The bail hearing for Cody Michell has been set aside for now.

Michell was taken into custody earlier in September, after a fatal crash in Crescent Heights on September 11. He allegedly stole a truck and trailer on that day, later driving at excessive speed along 12 Street Northeast and striking a van near Crescent Heights High School, flipping it on it’s side.

The truck then fled the scene, colliding with a Toyota Camry on Parkview Drive. The 18 year old girl at the wheel of the Camry was killed in the crash. CHAT News is not releasing the woman’s name out of respect for the family.

Michell was taken to hospital after his arrest, and allegedly attempt to disarm a police officer at the Medicine Hat Regional Hospital, but was restrained.

Michell made his second appearance in court today via CCTV for a bail hearing, which was put aside to October 11. During his brief appearance today, it was revealed he is still seeking legal counsel.

He remains in custody until his next appearance.

He was originally charged with one count of dangerous driving causing death, two counts of hit and run, one count of dangerous driving, one count of possession of stolen property over $5,000, one count of possession of stolen property under $5,000 and one count of attempting to disarm a police officer.

According to court documents, Michell pleaded guilty to an assault charge in Medicine Hat on August 21.

He received a $100 fine and one day in jail.

Michell also has a criminal history in Camrose. In June, he pleaded guilty to a charge of shoplifting under $5,000, receiving a $600 fine and a $180 surcharge. On August 16, he pleaded guilty to charges of breach of recognizance and causing a disturbance while intoxicated, receiving 10 days in jail and a $100 fine.
