CALGARY, AB. – The death of a four-year-old girl at a Calgary intersection just over two years ago has sparked a lawsuit against city police by the child’s parents.

Avayah Toulon was hit by a pickup truck at an intersection and her parents say in a statement of claim that police incorrectly said the driver stopped before the intersection and was waved through by one of the parents.

Craig and Samantha Toulon also claim that this resulted in the dropping of charges against the driver last October and sparked hatred, ridicule and contempt towards the family.

Police apologized to the family last fall and issued a retraction to their media release.
