Alberta Court of Appeal strikes down part of province’s impaired driving law

EDMONTON — The Alberta Court of Appeal has struck down part of the provincial government’s impaired driving legislation.

The court struck down a provision allowing authorities to take away the licence of a suspected impaired driver until the case is resolved in court.

Lawyers argue a driver waiting for their trial would have do do so without having a licence for six months or longer due to a backlog in the courts. Some drivers were pleading guilty to get the trial over with.

Lawyers also argued if drivers have not been found guilty, taking away their ability to drive violates their Charter rights.
